Welcome to T-Gain. These Terms & Conditions ("Terms") govern your access to and use of the T-Gain mobile application, the companion website, and any related services (collectively, the "Service") operated by T-Gain ("we," "us," or "our"). By creating an account, downloading the app, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to create a T-Gain account. By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into a binding agreement in your jurisdiction.

2. Not Medical Advice

T-Gain is a habit-tracking and lifestyle tool focused on training, nutrition, sleep, and stress management. It is not a medical device, diagnostic tool, hormone-therapy product, or substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional with any questions you may have regarding a medical condition, exercise program, or dietary change. Never disregard professional medical advice or delay in seeking it because of something you have read or tracked in the Service.

3. Your Account

You are responsible for safeguarding your login credentials and for any activity that occurs under your account. Notify us immediately at tgain.app@gmail.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, abuse the Service, or pose a risk to other users.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Attempt to reverse-engineer, decompile, or extract source code from the app.
• Scrape, copy, or republish content from the Service without written permission.
• Upload or transmit malware, viruses, or content that infringes the rights of others.
• Use automated systems (bots, crawlers) to interact with the Service in ways that disrupt it.

5. Subscriptions, Free Trials, and Payments

Certain T-Gain features may require a paid subscription ("T-Gain Pro"). Subscriptions are billed through the Apple App Store or Google Play in accordance with their respective terms. Unless cancelled at least 24 hours before the end of the current period, subscriptions auto-renew at the then-current price. You can manage or cancel your subscription at any time in your device's account settings. Refunds are governed by the applicable app store policy.

6. User Content

You retain ownership of the logs, notes, and personal data you enter into the Service ("User Content"). You grant T-Gain a limited, worldwide, royalty-free license to host, store, display, and process your User Content solely to operate and improve the Service for you. We do not sell your User Content.

7. Intellectual Property

The Service — including its design, branding, text, graphics, code, and trademarks — is owned by T-Gain or its licensors and is protected by copyright, trademark, and other laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

8. Third-Party Services

The Service may integrate with third-party platforms (e.g., Apple HealthKit, Google Fit, Firebase, app stores). Your use of those services is subject to their own terms and privacy policies. T-Gain is not responsible for the practices of third parties.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of Liability

To the maximum extent permitted by law, T-Gain and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD $50.

11. Indemnification

You agree to defend, indemnify, and hold harmless T-Gain from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

12. Termination

You may stop using the Service at any time and delete your account from within the app. We may suspend or terminate your access if you violate these Terms or if continued provision of the Service to you becomes commercially impractical. Sections that by their nature should survive termination (e.g., Disclaimers, Limitation of Liability, Intellectual Property) will survive.

13. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other reasonable means before the changes take effect. Continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which T-Gain is established, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located there for any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer-protection laws of your country of residence.

Privacy Policy

This Privacy Policy explains how T-Gain collects, uses, and shares information when you use the Service. By using the Service you agree to the practices described here.

1. Information We Collect

• Account information: name, email address, and password (hashed) when you sign up.
• Habit data: the training, fueling, sleep, and recharge entries you choose to log.
• Device data: device type, OS version, app version, crash logs, and similar diagnostic information.
• Usage data: anonymized analytics about how features are used so we can improve the app.

2. How We Use Information

We use your information to operate the Service, sync your data across devices, deliver reminders you've opted into, troubleshoot bugs, prevent abuse, and improve the product. We do not sell your personal information and we do not share habit data with advertisers.

3. Legal Bases (EEA / UK Users)

Where required, we rely on the following legal bases: performance of our contract with you (to provide the Service), our legitimate interests (to keep the Service secure and improve it), your consent (e.g., for optional notifications), and compliance with legal obligations.

4. Sharing

We share information only with:

• Service providers who help us run the Service (e.g., Firebase for authentication and storage, app stores for billing), under contracts that limit their use of the data.
• Authorities when required by law or to protect rights, safety, or the integrity of the Service.
• Successors in the event of a merger, acquisition, or sale of assets, subject to this policy.

5. Your Rights

Depending on your jurisdiction, you may have the right to access, correct, export, or delete your personal information, and to object to or restrict certain processing. You can exercise most of these rights from within the app (Settings → Account). For anything else, email tgain.app@gmail.com.

6. Data Retention

We retain your account and habit data while your account is active. When you delete your account, we delete or anonymize your data within 30 days, except where we are required to retain it for legal or security reasons.

7. Security

We use industry-standard safeguards — encryption in transit, hashed credentials, and access controls — to protect your information. No system is perfectly secure, so please use a strong, unique password.

8. Children

The Service is not directed to children under 16, and we do not knowingly collect data from them. If you believe a child has provided us with personal data, contact us and we will delete it.

9. International Transfers

Your information may be processed in countries other than your own. Where required, we use appropriate safeguards such as Standard Contractual Clauses.

10. Changes

If we make material changes to this policy, we'll notify you in the app or by email before the changes take effect.
